Instructions on how to use the Texas Title Fees and how to load those into the 2015 Itemization in Encompass

  • Seller paid Title Fees on the purchase contract means the seller pays the Lender's portion and all but $100 of the Owners portion of the Title Commitment. 
  • The buyer's portion of the Title Costs on a purchase with the seller paying is $100, plus the Endorsements.
  • The Buyer's Title Costs should be put in the 2015 Itemization as Owner's Title Insurance.  
  • If the Seller is paying for Title Insurance, the Lender's Title Fees need to be put in the Buyer's column on the 2015 Itemization and then add a Seller credit in the seller credit line. This is the way the Loan Estimate and the CD will be prepared and the Cost Estimate will reflect the Seller Credit.
  • If the Buyer is paying all Title Fees you just have to leave out the Seller Credit. 
  • In an initial cost estimate you may want to not include a Seller Credit so they understand this has to be negotiated into the Purchase Contract.
